CONCURRENT SESSION: The Claim Game: compensating athlete injuries - is there a better way?

 

Facilitated by Michael Chance from Rugby Australia, the three panellists for this session Eric Windholz, Will MacArthur and Rebecca Giordano will offer insights drawing from their extensive knowledge and experience within the academic, sports insurance and national sporting body/players union sectors across Australia and New Zealand. The session will delve into the availability for professional athletes in Australia and New Zealand to access current workers compensation regimes, challenge the status quo and consider whether there is a better way to compensate athletes for their injuries during and post career.  

 

Dr Eric L. Windholz, Associate Professor, Faculty of Law, Monash University

 

Eric is an Associate Professor in the Law Faculty at Monash University. Eric’s research focuses on two areas: (1) regulatory theory and practice, or what he describes as the science and art of modern regulatory practice; and (2) sports law, and in particular the application of regulatory theory to the world of professional sport - thus combining his two areas of expertise.

 

Through his research, Eric explores how business, government and civil society intersect and combine to regulate sport – nationally and internationally. After all, sport inherently is a system of rules and, thus, a regulatory system. Without rules there is no sport – just play!

 

Eric brings to his research a unique multi-disciplinary perspective forged from more than 35 years' experience: first in private practice with Arthur Robinson & Hedderwicks (now Allens); second in-house with the Philip Morris Group of Companies in Australia, Hong Kong and New York; and third as a regulator of industry with WorkSafe Victoria, in which he held a series of senior positions including General Counsel and General Manager.

 

Eric has written extensively on sports law issues, presents regularly at national and international conferences, consults to government departments and agencies, and is a frequent media commentator on contemporary sporting issues. Eric is the author of Governing through Regulation: Public Policy, Regulation and the Law (2018), and is currently in the process of writing his second book - The Transnational Regulation of Sport: Power and Passion.

 

Will MacArthur, Manager of Innovation at Gow-Gates Group

 

Will is the Manager of Innovation at Gow-Gates Group, bringing over 16 years of expertise in sports insurance to his role. Prior to his current position, Will was the Manager of Sports Insurance at Gow-Gates, where he played a pivotal role in developing and managing insurance programs for numerous National Sporting Associations. His extensive experience in the industry has equipped him with a profound understanding of the unique risks and insurance needs faced by athletes and sporting organisations.

 

Will's career at Gow-Gates is marked by his commitment to innovation and excellence, continuously seeking to enhance insurance solutions to better serve the sporting community. His deep knowledge of the sector and his ability to navigate complex insurance landscapes make him a leader in the sports insurance industry. His expertise provides valuable guidance for athletes, coaches, and sports administrators aiming to safeguard their careers and organisations.

 

 

Rebecca Giordano, Senior Legal Counsel, New Zealand Rugby Players Association

 

Rebecca is a senior sports lawyer with a 15+ year career that extends across international sports events, sport federations and significant sports brands. Her experience includes advising the Global Sports Marketing team at adidas International (Amsterdam) and representing the International Paralympic Committee in anti-doping hearings and athlete classification appeals (Bonn, Germany). She advised both organising committees of the ICC Women’s Cricket World Cup 2021 and the Rugby World Cup 2021 (played in 2022), recently led the regulatory framework at New Zealand Rugby and is now the legal in-house lead for the New Zealand Rugby Players’ Association. Rebecca is a former ANZSLA Director (2019-2021) and currently sits on the selection panels of Gymnastics New Zealand and Paralympics New Zealand.

 

Rebecca holds a Bachelor of Physical Education (sports science) and LLB (Otago, New Zealand) and is a graduate (with distinction) of the International Master in Management, Law and Humanities of Sport (Neuchatel, Switzerland). She also has a number of national sporting honours to her name, representing New Zealand in touch, hockey (U18) and volleyball (U19). Rebecca lives in Auckland with her husband and two young children.
